In December 2024, the U.S. Department of Justice filed a lawsuit against District Attorneys Matt Ballard and Carol Iski, alleging they prosecuted crimes involving Native Americans without proper jurisdiction, violating the Supreme Court's McGirt v. Oklahoma ruling.
The legal dispute centers on the 2020 U.S. Supreme Court decision, which affirmed that much of eastern Oklahoma remains Native American reservation land. This ruling clarified that crimes involving Native Americans on reservation land fall under federal and tribal jurisdiction, not state authority.
Matt Ballard is Accused of prosecuting a Navajo Nation member for alleged conduct on the Cherokee Reservation.
Carol Iski is Alleged to have filed charges against Native American individuals for crimes within the Muscogee (Creek) Nation's reservation.
